Who can apply for unemployment insurance?
In principle, any formal worker who is fired without just cause can apply for unemployment insurance. By the way, domestic servants also have this right.
Together, the government also grants the benefit to:
- Workers with a formal contract who were dismissed to take a course;
- Fishermen in the closed season;
- People rescued from situations analogous to slavery.
In this sense, after dismissal, the worker has 7 to 120 days to apply for unemployment insurance. Domestic workers, on the other hand, have between 7 and 90 days to claim their benefit. In addition, there are a few more requirements to receive unemployment insurance:
- Have a signed portfolio;
- Not having another type of income that sustains itself (for example, CNPJ in the name);
- Not receiving another benefit such as INSS.
Similarly, for domestic workers there are also some specific conditions. In addition to being fired without just cause, you must have worked as a domestic for at least 15 months. The employee must have 15 FGTS payments as a domestic employee, and also 15 contributions to the INSS. Finally, the same rules apply: you cannot have other support or receive other benefits, such as sick pay.
It is worth mentioning that the payment of unemployment insurance is only made by Caixa Econômica Federal. That is, to receive it, you must have an account or go to one of the branches.
How to apply for unemployment insurance?

- Access the website portal gov.br;
- Search for “Solicitar Seguro Desemprego” and click on the link;
- On the right side of the screen, you will find the option “Request”;

- Enter the claim number and request your benefit status;

- Click finish and finish.

- Salary until the day you worked;
- FGTS withdrawal;
- Accrued vacations plus one-third of the amount;
- Proportional vacations for the period, also plus a third of the amount;
- Indemnified or worked prior notice;
- Overtime, with an addition of 50% for weekdays and 100% for hours worked on Sundays and holidays;
- Indemnity of 40% of the amount withdrawn from the FGTS;
- Thirteenth proportional salary.
It is worth remembering that prior notice is indemnified or worked. This happens because when a company is going to fire an employee, it needs to notify 30 days in advance. However, in some cases, the company does not want the employee to continue working for the next 30 days. In this way, they end up compensating the collaborator.
Therefore, if you are fired without just cause and do not work for the next 30 days, you will receive your full salary as soon as you leave the company. In addition, the company must still pay an additional for each year worked in the company. Therefore, one year is equivalent to 3 days of notice. It is worth remembering that you must receive payment within 10 calendar days after the date of dismissal.
